1. Aceptación de los Términos

Al registrarse, acceder o utilizar la aplicación móvil Jamudi ("la Aplicación"), usted ("el Usuario") acepta quedar vinculado por los presentes Términos y Condiciones de Uso ("Términos"). Si no está de acuerdo con estos Términos, no debe utilizar la Aplicación.

2. Descripción del Servicio

Jamudi es una aplicación de seguimiento y registro de patrones de sueño, alimentación y desarrollo para bebés y niños pequeños. La Aplicación permite registrar siestas, tomas, cambios de pañal, y proporciona estadísticas, sugerencias basadas en inteligencia artificial y contenido educativo sobre sueño infantil.

3. Aviso Médico Importante

LA APLICACIÓN NO CONSTITUYE CONSEJO MÉDICO. Jamudi es una herramienta de registro y seguimiento informativo. La información, sugerencias y contenidos proporcionados por la Aplicación, incluyendo aquellos generados mediante inteligencia artificial, NO reemplazan el diagnóstico, consejo o tratamiento de un profesional de la salud calificado.

El Usuario reconoce y acepta que:

• Las sugerencias de la Aplicación son orientativas y basadas en guías generales de sueño infantil.
• Cada bebé es único y puede requerir atención médica especializada.
• Ante cualquier preocupación sobre la salud o desarrollo de su hijo/a, debe consultar a un pediatra u otro profesional médico.
• Jamudi no se hace responsable por decisiones tomadas basándose exclusivamente en la información proporcionada por la Aplicación.

4. Elegibilidad y Registro

4.1. Para utilizar la Aplicación, el Usuario debe ser mayor de 18 años o la mayoría de edad aplicable en su jurisdicción.

4.2. El Usuario declara ser padre, madre o tutor legal del menor cuyos datos se registran en la Aplicación, o contar con la autorización expresa del padre, madre o tutor legal para hacerlo.

4.3. El Usuario se compromete a proporcionar información veraz y mantener actualizados sus datos de registro.

4.4. El Usuario es responsable de mantener la confidencialidad de sus credenciales de acceso.

5. Uso Aceptable

El Usuario se compromete a:

• Utilizar la Aplicación únicamente para fines personales y no comerciales.
• No intentar acceder de forma no autorizada a los sistemas de Jamudi.
• No utilizar la Aplicación para recopilar datos de otros usuarios.
• No reproducir, distribuir o modificar el contenido de la Aplicación sin autorización.

6. Propiedad Intelectual

6.1. Todos los derechos de propiedad intelectual sobre la Aplicación, incluyendo software, diseño, textos, gráficos, logos e interfaces, son propiedad exclusiva de Jamudi o sus licenciantes.

6.2. Los datos ingresados por el Usuario (registros de sueño, alimentación, etc.) son propiedad del Usuario. Jamudi obtiene una licencia limitada para procesarlos según lo descrito en la Política de Privacidad.

7. Inteligencia Artificial

7.1. La Aplicación utiliza servicios de inteligencia artificial de terceros para generar sugerencias personalizadas y análisis de patrones.

7.2. Estos análisis se basan en los datos proporcionados por el Usuario y en conocimiento general sobre sueño infantil.

7.3. Las sugerencias generadas por IA son orientativas y están sujetas a la limitación del Artículo 3 de estos Términos.

8. Disponibilidad del Servicio

8.1. Jamudi se esfuerza por mantener la Aplicación disponible de forma continua, pero no garantiza disponibilidad ininterrumpida.

8.2. Jamudi podrá realizar mantenimientos, actualizaciones o modificaciones que pueden afectar temporalmente la disponibilidad.

8.3. Jamudi no será responsable por pérdidas derivadas de interrupciones del servicio.

9. Limitación de Responsabilidad

9.1. EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY APLICABLE, JAMUDI NO SERÁ RESPONSABLE POR DAÑOS INDIRECTOS, INCIDENTALES, ESPECIALES, CONSECUENCIALES O PUNITIVOS.

9.2. La responsabilidad total de Jamudi en relación con el servicio no excederá el monto pagado por el Usuario en los últimos 12 meses (o cero si el servicio es gratuito).

10. Terminación

10.1. El Usuario puede eliminar su cuenta en cualquier momento desde la configuración de la Aplicación o contactando a soporte.

10.2. Jamudi podrá suspender o terminar el acceso del Usuario por violación de estos Términos.

10.3. Tras la terminación, los datos del Usuario serán tratados conforme a la Política de Privacidad y la normativa aplicable de protección de datos.

11. Modificaciones a los Términos

11.1. Jamudi podrá modificar estos Términos en cualquier momento.

11.2. Los cambios se notificarán al Usuario a través de la Aplicación antes de su entrada en vigor.

11.3. El uso continuado de la Aplicación tras la notificación de cambios constituye aceptación de los Términos modificados.

12. Legislación Aplicable y Jurisdicción

12.1. Estos Términos se rigen por las leyes de la República de Chile.

12.2. Para usuarios residentes en la Unión Europea, estos Términos no afectan los derechos irrenunciables que les confiere la legislación de protección al consumidor de su país de residencia, incluyendo el Reglamento General de Protección de Datos (RGPD/GDPR).

12.3. Para usuarios residentes en los Estados Unidos, estos Términos se complementan con las disposiciones aplicables del California Consumer Privacy Act (CCPA) y demás legislación estatal pertinente.

12.4. Cualquier controversia será sometida a los tribunales ordinarios de Santiago de Chile, sin perjuicio del derecho del consumidor a acudir a los tribunales de su domicilio cuando la legislación local así lo exija.

1. Acceptance of the Terms

By registering, accessing, or using the Jamudi mobile application ("the App"), you ("the User") agree to be bound by these Terms and Conditions of Use ("Terms"). If you do not agree with these Terms, you must not use the App.

2. Description of the Service

Jamudi is an application for tracking and recording sleep, feeding, and development patterns for babies and young children. The App allows users to log naps, feedings, and diaper changes, and provides statistics, AI-based suggestions, and educational content about infant sleep.

3. Important Medical Notice

THE APP DOES NOT CONSTITUTE MEDICAL ADVICE. Jamudi is an informational tracking and record-keeping tool. The information, suggestions, and content provided by the App, including those generated through artificial intelligence, do NOT replace the diagnosis, advice, or treatment of a qualified healthcare professional.

The User acknowledges and agrees that:

• The App's suggestions are advisory and based on general infant sleep guidelines.
• Every baby is unique and may require specialized medical attention.
• For any concerns about your child's health or development, you should consult a pediatrician or other medical professional.
• Jamudi is not responsible for decisions made based solely on the information provided by the App.

4. Eligibility and Registration

4.1. To use the App, the User must be at least 18 years old or the age of majority applicable in their jurisdiction.

4.2. The User represents that they are the parent or legal guardian of the minor whose data is recorded in the App, or that they have the express authorization of the parent or legal guardian to do so.

4.3. The User agrees to provide truthful information and keep their registration data up to date.

4.4. The User is responsible for maintaining the confidentiality of their access credentials.

5. Acceptable Use

The User agrees to:

• Use the App solely for personal, non-commercial purposes.
• Not attempt unauthorized access to Jamudi's systems.
• Not use the App to collect data about other users.
• Not reproduce, distribute, or modify the App's content without authorization.

6. Intellectual Property

6.1. All intellectual property rights over the App, including software, design, text, graphics, logos, and interfaces, are the exclusive property of Jamudi or its licensors.

6.2. Data entered by the User (sleep, feeding records, etc.) belongs to the User. Jamudi obtains a limited license to process it as described in the Privacy Policy.

7. Artificial Intelligence

7.1. The App uses third-party artificial intelligence services to generate personalized suggestions and pattern analysis.

7.2. These analyses are based on data provided by the User and on general knowledge about infant sleep.

7.3. AI-generated suggestions are advisory and subject to the limitation in Article 3 of these Terms.

8. Service Availability

8.1. Jamudi strives to keep the App continuously available but does not guarantee uninterrupted availability.

8.2. Jamudi may perform maintenance, updates, or modifications that may temporarily affect availability.

8.3. Jamudi will not be liable for losses resulting from service interruptions.

9. Limitation of Liability

9.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JAMUDI WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

9.2. Jamudi's total liability in connection with the service will not exceed the amount paid by the User in the last 12 months (or zero if the service is free).

10. Termination

10.1. The User may delete their account at any time from the App's settings or by contacting support.

10.2. Jamudi may suspend or terminate the User's access for violation of these Terms.

10.3. After termination, the User's data will be handled in accordance with the Privacy Policy and applicable data protection regulations.

11. Modifications to the Terms

11.1. Jamudi may modify these Terms at any time.

11.2. Changes will be communicated to the User through the App before they take effect.

11.3. Continued use of the App after notice of changes constitutes acceptance of the modified Terms.

12. Governing Law and Jurisdiction

12.1. These Terms are governed by the laws of the Republic of Chile.

12.2. For users residing in the European Union, these Terms do not affect the non-waivable rights granted by the consumer protection legislation of their country of residence, including the General Data Protection Regulation (GDPR).

12.3. For users residing in the United States, these Terms are supplemented by the applicable provisions of the California Consumer Privacy Act (CCPA) and other relevant state legislation.

12.4. Any dispute will be submitted to the ordinary courts of Santiago, Chile, without prejudice to the consumer's right to resort to the courts of their domicile when local law so requires.
